Terms & Conditions (User Agreement)

1. Terms

All Users should read all the ExpaTrust.com Terms and Conditions (T&C) carefully, as they affect their rights and liabilities, and ensure that they understand them, before using the Website. The purpose of the T&C is to define the terms and conditions on which Expatrust.com shall directly or via a Partner’s website: provide access to and allow Users to browse the Website, provide Users with services allowing them to sell or buy Products to or from each other, and list Products for sale that it owns directly to Users. Users will be agreeing to the T&Cs as soon as they browse the Website including when they create an account and regardless of whether or not they complete any transactions through the Website. If a User does not want to be bound by the T&Cs, he/she should not access, register, use or list any Products or place any Orders with Expatrust.com.

2. Registration on the ExpaTrust.com website

2.1. In order to access the Website’s features, Users must create an account using their valid email address and a password. There are no restrictions on or charges for opening an account, and no purchase or sale is necessary on the Website. Users must be aged 18 or over and have full legal capacity to make a sale.

2.2. Only the registered User is authorised to use his/her account using a nickname for the user ID (provided when creating their Profile Information) and the password created when registering with the Website. This information, which the User shall be responsible for, is required every time a browsing session is opened and must not be disclosed by the User to any third party or be used by a third party. Users may not create or use any additional accounts using either the User’s own identity or the identity of a third party.

2.3. Users must not use nicknames that infringe any third-party rights. Users are informed that if a nickname is chosen by a User that is defamatory, harmful, threatening, vulgar, obscene, hateful, discriminatory or otherwise reprehensible or infringing of an intellectual property right, Expatrust.com reserves the right to ask the User to change it to an expression acceptable under these Conditions of Use or to delete it.

2.4. Users are not allowed to use a nickname allowing another selling site than the Website to be identified. In the event of non-compliance with that prohibition, ExpaTrust.com reserves the right to delete the User’s account, straight away.

2.5. Users promise not to complete the registration form using fictional and/or incorrect contact details or information. Users also promise to inform ExpaTrust.com using the contact form as soon as they become aware of any fraudulent use of their personal nickname, user ID and/or password by a third party. Users agree to compensate ExpaTrust.com against all losses it incurs or suffers arising from the use by any other person accessing the Website using the User’s account information where he/she has permitted or knows about such use.

2.6. Confirmation of the account activation will be sent to the User via the email address given.

3. Creating Item Information (Listing)

The Item’s features mentioned in the Details/Description, including, but not limited to, the Item’s condition, must match the features as declared by the Seller. Items listed for sale must be available for Buyers to order for as long as the Item’s Information remains published on the Website. A listed Item can therefore be temporarily or permanently removed from the Website by a Seller at any point if the Item has not been ordered, by deleting the Item from User’s Listings.

4. Seller’s obligations

Users agree to sell only Items of which they are the sole owner or, in the case of second hand goods dealers/shops, on behalf of persons who are the sole owners of the Items. Users must ensure they are not infringing any applicable laws and regulations or third-party rights in any way whatsoever by submitting Item Information to ExpaTrust.com or listing an Item for sale via the Website. Users promise that the condition and specification of the Items they list on the Website are as described in the Item’s Details/Description.

5. Process for approving Listing

To ensure the consistency of the Items listed for sale on the Website, ExpaTrust.com reserves the right to accept or refuse a Seller’s Item listing before it is posted on the Website and, where appropriate, provide modifications to the Item main photograph, within the limit of a simple silhouetting on white/neutral background. If the Item Information is accepted, ExpaTrust.com will send the User an email confirming that. The curating services offered by ExpaTrust.com are currently free of charge.

6. Listing Modifications

After Item is being posted on the Website Seller may request to modify his/her Item Information or answer on questions/comments in the section reserved for this purpose. The Seller has the possibility of changing Item’s Price or moving it into Free section at any time via Manage Item option on Item’s Listing page

7. Listing Posting Period

All listings will be posted for a period of six (6) months and will be automatically removed if the extended renewal period offered to you by email, is not confirmed.

8. Privacy Policy

8.1. ExpaTrust.com collects information from User when he/she registers on ExpaTrust.com Website, subscribe to newsletter or fill out a contact form. ExpaTrust.com collects and processes the following data: email, title, first name, last name, country, password, addresses, telephone number(s), IP address, connection data and navigation data when you authorize it, history of orders, transactions, claims, incidents, correspondence on our Website. Any of the information ExpaTrust.com collects from the Users may be used in one of the following ways:

Upon collection, you are informed by a star whether the data to be provided iscompulsory or optional. Some of the data is collected automatically depending on your actions on the website (see paragraph relating to cookies). We collect the information that you provide us with in particular when:

- you create your Profile Form;

- you purchase or sell a product on the Site;

- you browse the Site and consult products;

- you take part in a sweepstakes or a competition; and

- you contact our customer service.

Note: If at any time you would like to unsubscribe from receiving newsletter emails, there are unsubscribe option at the bottom of each newsletter email.

8.2. ExpaTrust.com implements a variety of security measures to maintain the safety of your personal information when you enter, submit, or access your personal information.

ExpaTrust.com neither sells nor shares your personal data to third parties formarketing purposes without your prior consent. However, we may share non-personally identifiable information, such as aggregated user statistics, with third parties without your consent.

(a) When You Agree To Receive Information From Third Parties. You may be presented with an opportunity to receive information and/or marketing offers directly from third parties. If you do agree to have your personal information shared, your personal information will be disclosed to such third parties and all information you disclose will be subject to the privacy policy and practices of such third parties. We are not responsible for the privacy policies and practices of such third parties and, therefore, you should review the privacy policies and practices of such third parties prior to agreeing to receive such information from them. If you later decide that you no longer want to receive communication from a third party, you will need to contact that third party directly.

(b) Third Parties Providing Services on Our Behalf. We may use third party vendors to perform certain services on behalf of us or the Site, such as hosting the Site, designing and/or operating the Site’s features, tracking the Site’s activities and analytics, and enabling us to send you special offers or performing other administrative services. We may provide these vendors with access to user information, including Device Identifiers and personal information, to carry out the services they are performing for you or for us. While we may use third party analytics service providers to evaluate and provide us with information about the use of the Site and viewing of our content, we do not share personal information with these analytics service providers, but they may set and access their own Tracking Technologies on your Device and they may otherwise collect or have access to information about you.

(c) Administrative and Legal Reasons. We may access, use, preserve, transfer and disclose your information (including Device Identifiers and personal information), including disclosure to third parties: (i) to satisfy any applicable law, regulation, subpoenas, governmental requests or legal process if in our good faith opinion such is required or permitted by law; (ii) to protect and/or defend the Site’s Terms of Use or other policies applicable to the Site, including investigation of potential violations thereof; (iii) to protect the safety, rights, property or security of the Site or any third party; and/or (iv) to detect, prevent or otherwise address fraud, security or technical issues. Further, we may use IP address or other Device Identifiers, to identify users, and may do so in cooperation with third parties such as copyright owners, internet service providers, wireless service providers and/or law enforcement agencies, including disclosing such information to third parties, all in our discretion, subject to applicable law. Such disclosures may be carried out without notice to you.

Identifiers and personal information and Usage Information with our parent, subsidiaries and affiliates. We also reserve the right to disclose and transfer all such information: (i) to a subsequent owner, co-owner or operator of the Site or applicable database; or (ii) in connection with a merger, consolidation, restructuring, the sale of substantially all of our interests and/or assets or other corporate change, including, during the course of any due diligence process.

Purposes

The main purpose of personal data collection is to offer you an optimal, efficient and personalized experience. You authorize us to use your personal data for the following:

- provide our services or process transactions that you have requested or agreed to receive

- solve possible problems and disputes;

- personalize, value, improve our services and content;

8.3. Cookies and other Tracking Technologies

In addition to any personal information or other information that you choose to submit to us, we and our third-party service providers may use a variety of technologies that automatically (or passively) collect certain information whenever you visit or interact with the Site (“Usage Information”), which technologies may be downloaded to your Device (defined below) and may set or modify settings on your Device. A few of the methods that may be used to collect Usage Information include, without limitation, the following (and subsequent technology and methods hereafter developed): Cookies.

Generally, ExpaTrust.com uses cookies for the purposes of improving and personalizing the website and/or measuring the amount of users. Cookies are files that are recorded on your computer’s hard drive when you are browsing the web and the website in particular.

A cookie is not used to gather personal data without informing you but to record information relating to your browsing of the website that can be directly read by ExpaTrust.com for when you visit and search the website afterwards (for example the pages you have consulted, or the date and time of your consultation of said pages). • Click on “Privacy” and the Privacy Settings tab allows you to control which types of cookies Internet Explorer accepts, and configure the Pop-up Blocker.

• Adjusting cookie settings for IE Privacy involves moving the slider to adjust general cookie settings, or clicking the Sites, Import, Advanced, or Default buttons to set specific rules for cookie handling.

Delete your cookies:

• Click on “Tools” then on “Internet options”.

Safari:

Rejecting cookies:

Web Beacons.

Small graphic images or other web programming code called web beacons (also known as “1x1 GIFs” or “clear GIFs”) may be included in our Site’s pages and messages. Web beacons may be invisible to you, but any electronic image or other web programming code inserted into a page or e-mail can act as a web beacon. Web beacons or similar technologies may be used for a number of purposes, including, without limitation, to count visitors to the Site, to monitor how users navigate the Site, to count how many e-mails that were sent were actually opened or to count how many particular articles or links were actually viewed.

Embedded Scripts.

An embedded script is programming code that is designed to collect information about your interactions with the Site, such as the links you click on. The code is temporarily downloaded onto your Device from our web server or a third party service provider, is active only while you are connected to the Site, and is deactivated or deleted thereafter.

ETag, or entity tag.

A feature of the cache in browsers. It is an opaque identifier assigned by a web server to a specific version of a resource found at a URL. If the resource content at that URL ever changes, a new and different ETag is assigned. Used in this manner ETags are a form of Device Identifier. ETag tracking may generate unique tracking values even where the consumer blocks HTTP, Flash, and HTML5 cookies. There may be other Tracking Technologies now and hereafter devised used by us in connection with the Site. Further, third parties may associate Tracking Technologies with our Site. The Site may include functionality that allows certain kinds of interactions between the Site and your account on a third party web site. The use of this functionality may involve the third party web site providing certain information, including personal information, to the Site.

For example, when you register with the Site, you may choose to use your Facebook account provided by a third party site to facilitate the registration and log-in process on the Site. If you choose to use this functionality, the third party site may send personal information about you to the Site, which we will then treat as personal information under this Privacy Policy. This Privacy Policy does not apply to the methods for collecting information used by these third party advertisers and others or the use of the information that such third parties collect. We make no representations regarding the policies or practices of third party advertisers or advertising networks.

8.7.By using ExpaTrust.com Website, you as a User consent to ExpaTrust.com privacy policy.

8.8. If ExpaTrust.com decides to change its privacy policy, those changes will be posted on this page.

9. Disclaimer

9.1.The materials on ExpaTrust.com web site are provided "as is". ExpaTrust.com makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, ExpaTrust.com does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

9.2. ExpaTrust.com is not responsible for any conflict situations between Seller and Buyer in the process of sell & buy negotiations, process or purchasing, payment, etc. However, ExpaTrust.com will be grateful to its registered Users for reporting on any significant non-compliance or misbehaviour from the side of any Buyer or Seller, registered on ExpaTrust.com. Such complains can be submitted via ExpaTrust.com on-line contact form. In such reported cases ExpaTrust.com reserves the right to delete the account of non-compliant User, straight away.

10. Limitations

In no event shall ExpaTrust.com or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on ExpaTrust.com Internet site, even if ExpaTrust.com or an ExpaTrust.com authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

11. Revisions and Errata

The materials appearing on ExpaTrust.com web site could include technical, typographical, or photographic errors. ExpaTrust.com does not warrant that any of the materials on its web site are accurate, complete, or current. ExpaTrust.com may make changes to the materials contained on its web site at any time without notice. ExpaTrust.com does not, however, make any commitment to update the materials.

Expatrust.com has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Expatrust.com of the site. Use of any such linked web site is at the user's own risk.

14. Governing Law

Any claim relating to Expatrust.com web site shall be governed by the laws of The Netherlands without regard to its conflict of law provisions. We are committed to conducting our business in accordance with these principles in order to ensure that the confidentiality of personal information is protected and maintained.
